Heads up. The app license is the EULA. These Terms of Service ("ToS") cover everything else: your use of this website, our backend APIs, social features, and the relationship between you and Delta Metrics. If anything in the EULA conflicts with this ToS, the EULA wins for app-related issues.
1. Acceptance of terms
By accessing or using beerbuddy.deltametricsai.com (the "Site") or any service provided by Delta Metrics LLC at this domain (collectively with the Beer Buddy app, the "Service"), you agree to be bound by these Terms of Service ("ToS"), our Privacy Policy, and, if you use the Beer Buddy mobile application, our End-User License Agreement. If you do not agree, do not use the Service.
2. Age & eligibility
You must be at least 21 years of age, or the legal drinking age in your jurisdiction (whichever is higher), to use the Service. You represent and warrant that you meet this requirement and that the information you provide is accurate.
3. Accounts
You are responsible for safeguarding your account credentials and for any activity under your account. Notify us immediately at support@deltametricsai.com if you suspect unauthorized access. We may suspend or terminate your account at any time for violation of these ToS, the EULA, or applicable law.
4. Community guidelines
The Service contains social features. You agree not to post, upload, or transmit content that is unlawful, harassing, hateful, defamatory, fraudulent, sexually explicit, or that promotes underage drinking or self-harm. You agree not to impersonate any person or misrepresent your affiliation with any person or entity. We may, but are not obligated to, remove content or suspend accounts that violate these rules.
5. Purchases & subscriptions
In-app purchases and subscriptions are processed by Apple through the App Store and governed by Apple's terms in addition to ours. Specific subscription mechanics — auto-renewal, pricing, cancellation, refunds — are set out in Section 7 of the EULA.
6. Not medical or legal advice
Beer Buddy provides estimates intended for personal self-awareness. It is not a medical device, not a legal device, and must not be used to decide whether you are safe or lawful to drive, operate machinery, or take any other action whose risk depends on your blood-alcohol level. If you have been drinking, do not drive.
7. Intellectual property
The Site and the Service, including all text, graphics, code, logos, and trademarks, are owned by Delta Metrics LLC or its licensors and are protected by US and international intellectual-property laws. You receive no ownership rights by using the Service.
8. Copyright & DMCA
If you believe content on the Service infringes your copyright, send a DMCA notice to support@deltametricsai.com that includes (a) your physical or electronic signature, (b) identification of the copyrighted work, (c) identification of the allegedly infringing material and where it appears, (d) your contact information, (e) a statement that you have a good-faith belief that the use is not authorized, and (f) a statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the owner.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELTA METRICS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELTA METRICS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. Our aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the past twelve months and (b) US$100.
11. Termination
We may suspend or terminate your access to the Service, at our reasonable discretion, with or without notice, including for violation of these ToS. Provisions that by their nature should survive termination — including ownership, warranty disclaimers, indemnity, limitation of liability, and dispute resolution — survive.
12. Governing law & venue
These ToS are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The state and federal courts located in Los Angeles County, California have exclusive jurisdiction over any dispute, and you consent to personal jurisdiction there.
13. Changes
We may update these ToS at any time. When we make material changes we'll update the "Effective" date and, where appropriate, post notice on the Site. Continued use after a change takes effect means you accept the change.
